June 11, 2012 Town Board and Town Board Closed
TOWN OF LYONS
MINUTES OF REGULAR MEETING
June 11th, 2012
Meeting opened at 7:00pm. Present were chairman Joy Bartelson, supervisors Doug Day and Bill Henningfield, treasurer Geri Henningfield and clerk Karla Hill. 14 area residents and guests were in attendance. Bartelson led pledge of allegiance.
Motion by Bartelson to approve minutes of May 14th monthly meeting with 2 corrections to who made motions, seconded by Day, Carried.
Motion by Henningfield to approve the May treasurers report, seconded by Day, Carried.
Motion by Joy to approve paying bills for the month of May, seconded by Day, Carried.
Motion by Day to approve Class A, B, C liquor licenses as listed, seconded by Henningfield, Carried.
Motion by Henningfield to approve 5 bartender licenses, seconded by Day, Carried.
Correspondence-Bartelson reminded public of upcoming Board of Review. Clerk received copy of stipulation and order for dismissal filed May 10th, 2012 for the Bourdo vs Town of Lyons lawsuit.
Catherine Schmalfeldt, owner, was asked to speak in regards to request for rezone of property located at 1316 Brook Rd and known as NA282200007, parts of NLY500006. Requests rezone from A-1 to C-2 and C-1 for purpose of conforming present parcels and allowing creation of one additional parcel. Motion by Henningfield to approve rezone, seconded by Day, Carried.
David Held is requesting rezone and amendment to Walworth County Multi-jurisdictional Land Use Plan for property located off of State Hwy 36, 31.13 acres known as NLY900001B. Plan Commission determined that a public hearing would need to be set up with 30 days prior notice before approval of change to Lyons land use plan. Must be filed with Walworth County by September 6th to coordinate with County procedure. Motion by Bartelson to set public hearing to discuss amending Town of Lyons 2020(s/b2025) Land Use Plan on July 16th at 6:00pm, with a special Town Board meeting to discuss the same immediately following. Stated that Plan Commission would discuss rezone at August PC meeting. Question as to approval of rezone by Town Board on July 16 after public hearing. Second by Henningfield to motion by Bartelson to set public hearing for July 16th at 6:00pm, Carried. Motion by Henningfield to table rezone until July 16th special meeting, seconded by Day, Carried.
Clerk received an amended agreement for the Emergency Management grant for storm shelter at Country Estates. Motion by Bartelson to approve amendment #1 to the agreement, seconded by Day, Carried.
Motion by Day to approve Resolution 12-20 granting Hwy Superintendent authority to approve and sign Road Opening Permits for the Town of Lyons, seconded by Henningfield, Carried.
Floor was opened to Mr. Wanasek to discuss request by Ruth Vorpagel Trust to vacate several streets within Springfield. Wanasek discussed the need for a public hearing, and the authority of the Town Board to make the petitioner responsible for all notices. Motion by Henningfield to approve Resolution 12-21 to hold a public hearing on August 13th prior to Town Board meeting, with stipulation that petitioner will do all necessary publications and notices, seconded by Day, Carried.
Town Engineer, Mark Kolczaski, talked about improvements to Walberg and Thomsen Roads and warned that some lawn areas would get shouldered in the process. He felt it was necessary for the safety of having adequate shoulders. Questioned if Thomsen should be in base bid or as an alternate. Henningfield said it should be an alternate. Discussion about timing of bid opening. Motion by Bartelson to open bids for 2012 road improvements on July 2nd at 3:00pm, seconded by Day, Carried.
Some discussion in regards to pending Walworth County Ordinance pertaining to setbacks for animal housing and number of animals. Doc Houck, Plan Commission member, will send comments to Walworth County based on Plan Commission discussions. Town Board was satisfied with Mr. Houck responding on their behalf.
Old Business:
Ordinance Enforcer-none.
Building Inspector-none.
Fire Department-GG has firework permits out for June 23rd and July 3rd. Several big fires in Spring Prairie and Town of Lyons last week. Dave Rex reported that box for ambulance has been chosen, next payment probably needed in September. Joy asked about missing W-4s for Fire Department.
Highway Department-Dave Held reported that Mill Street Bridge had a sizeable chunk of pavement fall into river. Hwy Department put metal plate on for time being. 5-ton limit will be posted for time being. Discussion of funding options.
Walworth County Sheriff-none.
Motion by Bartelson to adjourn to closed session pursuant to SS 19.85(1)g at 7:50pm, seconded by Day, Carried. Town Board and building inspector, Dave Sturdevant, were present. Motion by Day to accept Sturdevant’s resignation, seconded by Henningfield, Carried. Motion by Bartelson to reconvene to open session at 9:05pm, seconded by Henningfield, Carried. No residents or guests were present.
Motion to adjourn open session at 9:06pm by Day, seconded by Henningfield, Carried.
