April 12, 2010 Town Board /Town Board Closed

TOWN OF LYONS
MINUTES OF REGULAR MEETING
April 12, 2010

Meeting opened at 7:00pm. Present were chairman William Mangold, supervisors Bill Henningfield and Jim Shimeck, treasurer Geri Henningfield and clerk Karla Hill. Also present were 18 area residents and guests. Chairman Mangold read notice of meeting. Mangold led pledge of allegiance. Motion by Shimeck to approve minutes of March 8th, 2010 meeting, seconded by Henningfield, Carried. Motion by Henningfield to approve March treasurer’s report, seconded by Shimeck, Carried. Motion by Shimeck to approve the paying of bills for the month of March, seconded by Henningfield, Carried. Motion by Shimeck to approve operator licenses, seconded by Henningfield, Carried. Mangold has received complaints about the seal coating on Gail Lynne Road. Also, received letter from Walworth County about short-term rentals. Clerk will put on next month agenda to discuss. Clerk will also put parking tickets on next month agenda.
Henningfield excused himself from awarding of the road bids due to possible conflict of interest. Mangold made a motion to accept B.R. Amon bid of $203,546.00 for 2010 road improvements, seconded by Shimeck, Carried. Shimeck made a motion to reject all other bids, seconded by Mangold, Carried.
Motion by Henningfield to approve Lentz conditional use for a recreational camp cottage with the limit of 12 guests in the cottage, seconded by Shimeck, Carried.
Country Estates Sanitary District resolution for right-of-way to construct new sampling station and to consider that resolution at a later date was discussed in detail. Representatives from both districts were in the audience. Consensus by Town Board was that after improvements have been made to CESD and new wastewater treatment plant has been built, necessity of the sampling station would be reevaluated. CESD did not think it was required by funding agents to have the resolution approved. Motion by Henningfield to table resolution indefinitely, seconded by Shimeck, Carried.
Golf Hills resident asked the Board to consider a sign on Barry Drive indicating that a deaf child was in the area. There was some discussion about the wording, Clerk had checked with the Town’s Association and Town Attorney. Dave Held, Highway Superintendent, had some information about appropriate wording for the signs. Andy Makar, Ordinance Enforcer, was going to check into it also. Shimeck stated he was certainly in favor of signage, but would like to be sure it was done properly. Motion by Shimeck to table to the May meeting, seconded by Henningfield, Carried.
Due to the fact that an important document needed to be signed by both districts by April 23rd, a tentative date for a joint district and board meeting was set for April 24th at 9:00am. Clerk will send notice to commissioners not present.
Associated Appraisals will be charging a fee for internet access to Town of Lyons assessment information. We will inquire about sample of the type of information available, how it will be billed, and terms of contract, if contract is necessary. Motion by Shimeck to table to the May meeting, seconded by Henningfield, Carried.
Motion by Henningfield to approve maintenance contract with Electra Kold for heating and air conditioning units in the amount of $752 per year, which includes twice a year visits, seconded by Henningfield, Carried.
Geri Henningfield had checked into drop box that could be placed in front vestibule for dropping off tax payments, and other materials for clerk & building inspector. Bill Henningfield questioned whether it should be a little larger than the model she was considering. Geri will look into a slightly larger one.
Motion by Shimeck to adjourn to closed session at 8:00pm, seconded by Henningfield, Carried.
