TOWN OF LYONS
MINUTES OF REGULAR MEETING
JANUARY 10, 2011
Meeting opened at 7:00pm. Present were chairman William Mangold, supervisor Bill Henningfield, treasurer Geri Henningfield, Clerk Karla Hill and 11 area residents and guests. Chairman Mangold read notice of meeting. Mangold led pledge of allegiance. Motion by Mangold to approve minutes of December 13th Town Board meeting, and December 16th special closed meeting, seconded by Henningfield, Carried. Motion by Henningfield to approve December treasurer’s report, seconded by Mangold, Carried. Motion by Henningfield to approve paying bills for the month of December, seconded by Mangold, Carried.
Correspondence-none.
Motion by Henningfield to approve a rezone of property known as tax key # NLY200001, owned by Delsie Everett, from M3 to A1 & C2 with the condition dead and dieing trees be replaced and restoration be completed as per Plan Commission recommendation, seconded by Mangold, Carried.
Doug Day, President of Country Estates Sanitary District, requested discussion and possible action in regards to the Town of Lyons granting as easement for the sanitary district to construct a metering/sampling manhole as required per contract with Lyons Sanitary District II. The Plan Commission did not approve granting of the easement. DNR would also not approve of construction of the sampling station in the railroad right-of-way. Currently, Sanitary II and CESD have access to manhole for sampling. Composite sampling, in new metering/sampling station, may give better results. Sanitary II inquired as to handling the problem of it being in the contract to build the station. Since a feasible location has not been found, board suggested amending the contract. Motion by Henningfield to deny the proposed easement along Church Street right-of-way, seconded by Mangold, Carried.
Plan commission unanimously approved Walworth County Resolution to allow veto authority for Towns on all conditional uses. Motion by Henningfield for Clerk to write letter to Walworth County stating that the Town of Lyons is in favor of the Resolution to allow veto authority for Towns on all conditional uses, seconded by Mangold, Carried.
After some discussion of adding subcategories for Fire Department expenses, motion by Henningfield to approve 2011 Budget as printed 10/9/2010, seconded by Mangold, Carried.
Since there were no impact fees in 2010, and interest was minimal, impact fees will not be transferred. Motion by Henningfield to table transfer of 2010 amounts to reserve accounts, seconded by Mangold, Carried.
Clerk read resolution for employee wages. Motion by Henningfield to approve employee wages per Resolution 11-01, seconded by Mangold, Carried.
Motion by Henningfield to table FD Resolution until after discussions at the FD executive board meeting, seconded by Mangold, Carried.

Motion by Henningfield to adjourn at 7:30pm, seconded by Mangold, Carried.
