TOWN OF LYONS PLANNING COMMISSION Meeting
MINUTES OF January 5, 2011

Meeting called to order by Dave Held at 7:30pm, official meeting notice and agenda read by Al Bjorkman.

Planning commissioners present were Dave Held, Dave Hill, Leonard Wardzala, and Al Bjorkman. Town Chair Bill Mangold and Town Supervisor Bill Henningfield were also present. Also in attendance were 5 town residents and interested persons.

APPROVAL OF MINUTES
Motion by Dave Hill, second by Al Bjorkman, to approve the last meetings minutes of 5/15/2010, carried.

JAMES PETERSON AND SONS INC, REQUESTS A REZONE OF PROPERTY OWNED BY DELSIE EVERETT FROM M3 TO A1 AND C2 FOR PROPERTY LOCATED ON HWY 36 AND KNOWN AS TAXPARCEL NLY200001.

Tim Peterson reporting. The Hwy 36 Bypass is complete and as part of the original rezone to M3 it was agreed at the completion of the project to rezone the property back to it’s original pre-project zoning of A1 and C2..
The only items left to complete are to replace the trees on the headlight berm that shields neighbors from oncoming headlights and to restore two sediment ponds once the weather gets toward spring and the growing season. All silt fence still on site will stay until all soil surface shave revegetated.
Was asked that the replacement trees need to have some growth guarantee and likely will need to be watered until they are established. New tree work will be in the spring at the beginning of the growing season. A farmer is already using the undisturbed lands for cropsd and the restored slopes for hay.
Peterson did not have an exact map of the boundaries of the original zoning but the commission was comfortable that the motion to rezone and the counties oversight would assure the original conditions of zoning were put back in place.

Motion by Al Bjorkman, Second by Leonard Wardzala to recommend to the Town Board approval of the rezone from M3 back to the original prior Hwy 36 bypass project A1 and C2 zoning boundaries, carried.

DOUG DAY, PRESIDENT OF COUNTRY ESTATES SANITARY DISTRICT, REQUESTS DIUSCUSSION OF AN EASEMENT WITH THE TOWN OF LYONS FOR THE SANITARY DISTRICT TO CONSTRUCT A NEW METERING/SAMPLING MANHOLE AS REQUIRED PER CONTRACT WITH LYONS SANITRAY DISTRICT 2.

Doug Day reports that they are already monitoring sewage output through a manhole cover in Church Street just north of the railroad grade trail ROW.. The contract with the operating district provides for a new manhole off of the street at the edge of the railroad trail ROW. The costs to do this would be in excess of $80,000.00. The primary reason for this manhole relocation effort was or is Sanitary District 2’s concern about access of the existing in a street for safety reasons. Mr. Day reports that they only use the existing manhole within Church Street 3-4 times a year for 5 minutes at a time by a person who traffic cones the area, uses a truck with a flashing light, and is in a bright traffic vest.

Considerable discussion. Commission feels that this ongoing use of the current manhole is safe as it is now being used and the cost to move it does not provide any safety or other benefit. Further, a letter from the Rails to Trails group and the DNTR oppose any structure in or near the trail ROW that could be hit by snowmobiles.

Motion by Al Bjorkman, second by Dave Hill to recommend denial to the Town Board of an easement to move the current manhole access point to another location, carried.

WALWORTH COUNTY RESOLUTIONTO ALLOW VETO AUTHORITY FOR TOWNSHIPS ON ALL CONDITIONAL USES

Al Bjorkman read a memo dated 12/7/2010 from Walworth County Zoning Agency. The county board is considering a resolution to ask the state of Wisconsin to modify Section59.69 of the state statutes to allow Town veto authority on conditional uses. Towns currently have veto authority on re-zones and this change would extend that to conditional uses.

Discussion seemed to favor this change putting more local control in the hands of Towns.

Motion by Dave Hill, second by Leonard Wardzala to recommend to the Town Board support of Walworth Counties proposed resolution to change state statue 59.56 to extend veto authority to Towns on conditional uses, carried.

Next meeting if there if there are any agenda items would be Wednesday, February 2, 2011 at 7:30pm.
