TOWN OF LYONS
MINUTES OF REGULAR MEETING
July 9, 2012
Meeting opened at 7:00pm. Present were chairman Joy Bartelson, supervisors Doug Day and Bill Henningfield, treasurer Geri Henningfield and clerk Karla Hill. 21 area residents and guests were in attendance. Bartelson led pledge of allegiance.
Motion by Henningfield to approve minutes of June11th monthly meeting, seconded by Day, Carried.
Motion by Day to approve the June treasurers report, seconded by Henningfield, Carried.
Motion by Day to approve paying bills for the month of June, seconded by Henningfield, Carried.
Correspondence-Doug Day thanked the Fire Department for their handling the Grand Geneva fireworks.
CESD request for easement to construct below grade sampling station was moved to first on the agenda. Doug Day excused himself from the board. Brandon Foss explained the proposal. Henningfield pointed out the #4 position was still in the Held easement. Brandon said he had not checked the location just north of the Held easement for underground utilities, etc. There would be a standard manhole cover. Motion by Henningfield to conditionally approve the designated “#5” position for the station, with #2 as an alternate and that CESD would come back with a certified survey map before final approval, seconded by Bartelson, Carried.
Doug Day returned to the board. CECA requested approval of a contract for administration fees in conjunction with the storm shelter grant. Much discussion about if the Clerk or the Town receives a portion of the fees. Motion by Henningfield to approve the contract with paragraph C being revised to state Town of Lyons in place of Karla Hill, seconded by Bartelson, Carried.
Henningfield stepped down to discuss awarding of the 2012 Road Bids. Motion by Day to award BR Amon the base bid plus alternate A totaling $178,472.00, seconded by Bartelson, Carried.
Henningfield returned to the board. The interim bridge inspection was discussed. Henningfield made a motion to table Baxter & Woodman proposal, seconded by Day, Carried.
Clerk inquired how the board wanted to proceed with hiring a building inspector. It was discussed to post for an inspector, asking for qualifications, contract proposal. Motion by Bartelson to have clerk post a request for building inspector applications to be turned in by August 6th, seconded by Day, Carried.
Clerk asked for clarification on whether a Town Board meeting was necessary after the public hearing on July 16th. No meeting necessary. Held requests will go to Aug. 8th Plan Commission and August 13th Town Board.
Building Inspector-temporary BI, Joe Mesler, was present, introduced himself, and spoke briefly during discussion on request for qualifications.
Fire Department- Dave held reported that the park was vandalized again last week. Lighting issues were again discussed. Dave Held will create a bid spec in order to get some more prices, and talk to WE Energies about different lighting scenarios. Some additional discussion on surveillance videos. Will look at Pody bid in August.
Walworth County Sheriff-none.
Motion by Bartelson to adjourn to closed session pursuant to SS 19.85(1)g at 8:07pm, seconded by Day, Carried. Board conferred with legal council, Ben Brantmeier, and Town Assessor, Paul Maul, in regards to claims against the Town brought forth by Timber Ridge property owners for excessive assessment of the 2010 and 2011 tax years. Motion by Day to authorize attorney Brantmeier to present a statutory offer of settlement to the plaintiffs, seconded by Henningfield, Carried unanimously.
Motion made by Day to adjourn closed session at 9:00pm, seconded by Henningfield, Carried. No residents were present. Motion made by Bartelson to adjourn open session at 9:04pm, seconded by Day, Carried.
